Terms & Conditions 

Welcome to Nook and Nestled! These Terms and Conditions outline the policies and expectations for our porch decorating services. By booking with us, you agree to the terms set forth below. These policies are designed to ensure clarity, fairness, and a seamless experience for both parties. Please read carefully and reach out with any questions prior to booking.

1. Services

1.1 Scope – Nook & Nestled specializes in seasonal front porch decorating, including in-person fall pumpkin installations and virtual holiday décor consultations. Additional services may be offered upon request.
1.2 Customization – All designs are customized based on the client’s space, preferences, and the package purchased. Final designs may vary slightly due to product availability and seasonal supply.
1.3 Virtual Services – For virtual consultations, we provide mood boards, product links, and styling recommendations. We do not guarantee product availability, quality, or delivery timelines from third-party vendors.

2. Booking & Payment

2.1 Full Payment Required – Payment in full is required at the time of booking to secure your installation date or virtual consultation.
2.2 Accepted Payments – We accept [list payment methods]. Your booking is not confirmed until full payment has been successfully processed.
2.3 Non-Refundable – All bookings are non-refundable due to the custom nature of our services and the seasonal procurement of materials.
2.4 Unpaid Bookings – If payment is not received at the time of booking, your requested service date will be released and may be offered to another client.

3. Cancellations & Rescheduling

3.1 Client Cancellations – All bookings are non-refundable. Cancellations made less than [X] days before the scheduled service will forfeit the full payment.
3.2 Rescheduling – Clients may reschedule their service one time without penalty if requested at least [X] days in advance, subject to availability.
3.3 Our Right to Cancel – Nook & Nestled reserves the right to cancel a service due to weather conditions, illness, supply shortages, or unforeseen circumstances. If we cancel, you will receive a full refund of any payments made, excluding products already purchased for your installation.

4. Products & Materials

4.1 Third-Party Products – Some products we recommend or install are sourced from third-party vendors. We are not responsible for manufacturing defects, shipping delays, or quality issues.
4.2 Amazon & Online Purchases – While we vet items based on reviews, we cannot guarantee product quality, color accuracy, or performance. Any product defects should be addressed directly with the seller.
4.3 Perishable & Organic Materials – Pumpkins, mums, gourds, plants, and other natural materials are organic substances. As such:

  • Each item is unique in shape, size, and coloration, and may contain natural imperfections.

  • We hand-select the best quality items available at the time of installation; however, due to the nature of organic products, we cannot guarantee longevity or condition after delivery.

  • Lifespan may be affected by factors outside our control, including temperature fluctuations, humidity, rain, frost, pests, sun exposure, and natural decomposition.

  • The internal quality of pumpkins and other produce cannot be inspected without cutting them open; therefore, hidden rot, mold, or early breakdown is possible and does not constitute damage or a service defect.
    4.4 Care Recommendations – We may provide general care tips to help extend the life of your décor, but following these tips does not guarantee results.
    4.5 No Replacement Guarantee – Once installation is complete, we are not obligated to replace perishable items that deteriorate due to natural causes. Replacement requests may be accommodated at the client’s expense and subject to product availability.

5. Installation Conditions

5.1 Client Responsibilities – The client must ensure the installation area is clean, accessible, and safe for our team.
5.2 Weather Considerations – Outdoor décor is subject to weather exposure. We are not responsible for damage caused by wind, rain, sun, pests, or other environmental factors.
5.3 Property Access – By booking, you grant us permission to access the property for the duration of installation and removal (if applicable).

6. Liability

6.1 Damage to Property – We take great care during installations, but Nook & Nestled is not liable for any incidental damage to your property, landscaping, or structures unless caused by gross negligence.
6.2 Personal Safety – Clients and bystanders must maintain a safe distance during installation. We are not responsible for injuries sustained during or after the installation.
6.3 Indemnification – You agree to hold harmless and indemnify Nook & Nestled from any claims, damages, or expenses arising from the services provided.

7. Intellectual Property

7.1 Ownership of Designs – All mood boards, product lists, design concepts, and photographs remain the intellectual property of Nook & Nestled. They may not be copied, reproduced, or shared for commercial use without our permission.
7.2 Photography Rights – We reserve the right to photograph and share completed projects for marketing purposes unless you request otherwise in writing before your service date.

8. Refund Policy

8.1 Services – Due to the custom nature of our work, all sales are final. No refunds will be issued once services are completed.
8.2 Products – Any product-related refunds must be handled directly with the retailer or manufacturer.

9. Force Majeure

We are not liable for delays or cancellations caused by events beyond our control, including but not limited to extreme weather, natural disasters, pandemics, transportation delays, strikes, or supply shortages.

10. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of [Insert State], without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms at any time. Updated versions will be posted on our website, and continued use of our services constitutes acceptance of the new Terms.
